Fiji Advances Competition Reform with Nationwide Consultations on New Commission Bill

Fiji has completed nationwide consultations on the draft Competition and Consumer Commission Bill 2026, marking a significant step toward overhauling its competition and consumer protection framework. The Ministry of Commerce and Business Development (MCBD) and the Fiji Competition and Consumer Commission (FCCC) conducted public consultations from July 27 to August 4, 2026, across nine locations, including Suva, Nadi, and Labasa.

Objectives of the Proposed Legislation

The proposed bill aims to replace the Fijian Competition and Consumer Commission Act 2010, establishing a modern framework for regulating market conduct and protecting consumers. Key objectives include:

  • Clearer Rules on Anticompetitive Conduct: Addressing issues such as cartels and abuse of market power to promote fair competition.
  • Strengthened Consumer Protection: Enhancing safeguards and fair trading practices to protect consumer interests.

Background and Development

This reform is part of a multi-year effort supported by the Pacific Private Sector Development Initiative (PSDI) to modernize Fiji's competition policy. Since 2016, PSDI has assisted in reviewing existing legislation, developing national policies, and drafting new competition and consumer protection bills. The Competition and Consumer Protection Policy was endorsed by Fiji's Cabinet in April 2020, laying the groundwork for the current legislative reforms.

Implementation and Future Steps

Following the consultations, the government will consider the feedback before proceeding with the legislative process. PSDI has committed to supporting Fiji beyond the passage of the bill, focusing on effective implementation and enforcement of the new framework. This includes strengthening the institutional capacity of the FCCC to ensure the success of the reforms.

The completion of these consultations represents a crucial milestone in Fiji's ongoing efforts to create a more effective business environment, balancing the promotion of open competition with robust consumer protection measures.
