AI Tools in HR May Violate Czech Labor Laws, Risking Hefty Fines

The integration of artificial intelligence (AI) systems into human resources (HR) practices is raising significant legal concerns in the Czech Republic. Recent analyses indicate that many AI tools used in HR processes may infringe upon existing labor laws, potentially leading to substantial fines of up to EUR 35 million.

Legal Framework and AI Implementation

The Czech Labor Code (Act No. 262/2006 Coll.) does not currently include specific provisions addressing the use of AI in employment contexts. However, its existing regulations present considerable challenges for the deployment of AI technologies in HR. Employers are required to ensure that any automated systems comply with labor laws, particularly concerning non-discrimination, data protection, and employee privacy.

EU AI Regulation and Compliance Obligations

The forthcoming EU Regulation 2024/1689 on artificial intelligence, set to take effect on August 2, 2026, classifies certain AI systems used in HR as "high-risk." This classification imposes stringent compliance requirements on employers, including:

  • Implementing robust data protection measures to prevent unauthorized access and misuse of employee information.
  • Ensuring transparency in AI-driven decision-making processes to avoid discriminatory practices.
  • Conducting regular audits and assessments to verify the fairness and accuracy of AI systems.

Non-compliance with these obligations can result in severe penalties, including fines up to EUR 35 million or 7% of the company's global annual turnover, whichever is higher.

Data Protection Impact Assessments

In addition to the AI Regulation, employers must also adhere to the General Data Protection Regulation (GDPR). Article 35 of the GDPR mandates that organizations conduct Data Protection Impact Assessments (DPIAs) when implementing AI technologies that process personal data. These assessments are crucial to identify and mitigate potential risks associated with data processing activities.

Recommendations for Employers

To navigate the complex intersection of AI implementation and labor law compliance, employers are advised to:

  • Engage legal and technical experts to ensure AI systems are designed and deployed in accordance with applicable laws.
  • Develop comprehensive policies and procedures that address the ethical use of AI in HR practices.
  • Provide training for HR personnel on the legal implications of AI tools and the importance of maintaining compliance.

By proactively addressing these issues, employers can harness the benefits of AI in HR while minimizing legal risks and safeguarding employee rights.
