Belgium Transposes New European Consumer Credit Rules: Key Changes Effective 20 November 2026

On 9 July 2026, the Belgian Parliament adopted an act transposing the European Directive on consumer credit (CCD II) into national law. This act represents a significant step forward in combating over-indebtedness and introduces several key changes to the consumer credit landscape in Belgium.

Key Changes Introduced

  • Expanded Scope of Consumer Credit Legislation: The legislation now includes certain forms of deferred payment and smaller loans, particularly targeting 'buy now, pay later' (BNPL) schemes, which were previously excluded from regulation.
  • Enhanced Information Requirements: Credit providers are required to provide clearer and more balanced information to consumers, ensuring transparency and informed decision-making.
  • Stricter Creditworthiness Assessments: Before granting credit, providers must conduct thorough assessments of a consumer's creditworthiness to promote responsible lending practices.

Implementation Timeline

The transposition act will come into force on 20 November 2026 and will apply to credit agreements where the credit has been applied for with the credit provider on or after that date. Credit providers must ensure that their amended credit agreement templates are submitted to the FPS Economy for approval by 20 November 2026 at the latest.
